These terms govern your use of https://therbcgroup.com (the "website"), operated by Real Building Constructions Private Limited, trading as RBC Group ("RBC Group", "we", "us"), a company incorporated in India on 2 September 2021 (GSTIN 03AALCR2528L1Z8) with its registered office at SCO 2B, SBP Lifestyle Square, Kharar–Landran Road, Sector 116, Mohali (SAS Nagar), Punjab 140301, India.
By using the website you accept these terms, our Privacy Policy, our Disclaimer and, where it applies, our Refund Policy. If you do not accept them, do not use the website. These terms are an electronic record under the Information Technology Act, 2000 and need no physical or digital signature.
2. Use of the website
The website gives information about our residential and commercial projects in Mohali and Kurali, Punjab, and lets you send us an enquiry. You may use it for your own lawful, non-commercial purposes. You must be at least 18 years old to submit an enquiry or to enter into any transaction with us.
The website does not accept payments today. If we enable online payment of booking amounts, our Refund Policy will apply to those payments.
We may change, suspend or withdraw any part of the website at any time without notice. We do not promise that it will be available without interruption or free of errors or harmful code.
3. Information is not an offer
Project details, images, plans, specifications, prices and availability on the website are indicative and may change without notice. Nothing on the website is an offer, an invitation to buy, an allotment or a promise. Only an Agreement to Sell or Builder-Buyer Agreement signed by both parties, and registered where the law requires, creates binding obligations. Read our Disclaimer before relying on any information.
4. Enquiries and communications
When you submit an enquiry, you confirm that the details are true, that the phone number and e-mail address are yours, and that you are entitled to share them.
By ticking the consent box, you authorise RBC Group and the service providers acting for us to contact you by phone call, WhatsApp, SMS and e-mail about your enquiry and about our projects. For the communications you have asked for, this consent applies even if your number is registered on the National Customer Preference Register (Do Not Disturb), in line with the Telecom Commercial Communications Customer Preference Regulations, 2018.
You may withdraw this consent at any time by replying STOP to an SMS or WhatsApp message, telling us during a call, or using the contact details on our Contact page. We will stop marketing communications within a reasonable time. We may still contact you about a booking or agreement you have entered into with us.
An enquiry or message sent through the website or WhatsApp is not a booking and does not reserve any unit.
5. Intellectual property
The names RBC Group, RBC Happy Homes, RBC Happy Homes-2, Vista Village and Vista Square, our logos, and all text, photographs, renders, plans, videos, graphics and the design of the website are owned by or licensed to Real Building Constructions Private Limited. They are protected by the Copyright Act, 1957, the Trade Marks Act, 1999 and other applicable law.
We give you a limited, revocable, non-transferable licence to view the website and to print or save pages for your personal reference while you consider a purchase. You may not copy, reproduce, republish, frame, scrape, modify or distribute any part of it, or use our names or marks in any advertisement, domain name, social media account or property listing, without our prior written permission.
6. Third-party services and links
The website uses or links to services run by others, including WhatsApp, Google Maps, Instagram, Facebook and Cloudflare. We do not control those services and are not responsible for their content, availability or privacy practices. Their own terms govern your use of them.
7. Prohibited conduct
You must not:
- use the website for any unlawful, fraudulent or misleading purpose;
- submit false information, or another person's details without their consent;
- impersonate RBC Group, any of our staff or any other person;
- hold yourself out as our agent, channel partner or representative, or advertise or offer our projects, without our written authorisation;
- use bots, scrapers or other automated means to access the website or submit forms, or try to bypass Cloudflare Turnstile or any other security control;
- upload or transmit viruses or other harmful code, or attempt unauthorised access to the website, its servers or its database;
- interfere with or overload the website, or disrupt its use by others.
Where we reasonably suspect a breach of this section, we may block access, delete submissions and report the conduct to the authorities.
8. Limitation of liability
The website and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we exclude all warranties about the website, whether express or implied.
To the fullest extent permitted by law, RBC Group and its directors, employees and agents are not liable for any indirect, incidental, special or consequential loss, or for any loss of profit, opportunity, data or goodwill, arising from your use of, or inability to use, the website, or from any decision made in reliance on its content. Our total liability for any claim arising from your use of the website is limited to ₹1,000 (Rupees One Thousand).
Nothing in these terms excludes or limits any liability that cannot be excluded or limited by law, any right you have under the Real Estate (Regulation and Development) Act, 2016 or the Consumer Protection Act, 2019, or our obligations under an agreement you sign with us.
9. Indemnity
You agree to indemnify RBC Group and its directors, employees and agents against any loss, damage, cost or expense, including reasonable legal fees, arising from your breach of these terms, your misuse of the website, any information you submit, or your infringement of any right of a third party.
10. Governing law and jurisdiction
These terms are governed by the laws of India. Subject to the jurisdiction that the Real Estate (Regulation and Development) Act, 2016 and the Consumer Protection Act, 2019 confer on their authorities and commissions, the courts at Mohali (SAS Nagar), Punjab have exclusive jurisdiction over any dispute arising from these terms or your use of the website.
11. Changes to these terms
We may revise these terms at any time by publishing an updated version on this page. The date at the top shows when they were last updated. If you continue to use the website after a change, you accept the revised terms.
12. Severability and waiver
If a court or authority finds any provision of these terms invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will stay in full force. A failure or delay by us in enforcing any provision is not a waiver of it.
