1. Scope and current status
This policy is issued by Real Building Constructions Private Limited, trading as RBC Group ("RBC Group", "we", "us"). It applies to booking or token amounts for property units paid through https://therbcgroup.com (the "website").
We do not accept any payment on the website today. If we enable an online payment facility, this policy will apply to every payment made through it from the date it goes live.
2. What a website payment can be for
A website payment may only be a booking or token amount for a specific unit in one of our projects, in an amount agreed with you in writing beforehand, such as in our booking form or allotment confirmation.
We never take payment on the website for enquiries, brochures, site visits, "registration", priority passes or any other purpose. If anyone asks you to pay through the website or any link for anything else, do not pay; report it to us. Pay only into accounts held in the name of Real Building Constructions Private Limited, and keep our official receipt.
3. The agreement governs
Every booking amount is subject to the booking or allotment documents you sign and, once executed, the Agreement to Sell or Builder-Buyer Agreement (the "Agreement"). If this policy conflicts with the Agreement, the Agreement prevails. If either conflicts with your rights under the Real Estate (Regulation and Development) Act, 2016 (the "RERA Act"), the Punjab rules made under it, or the Consumer Protection Act, 2019, the law prevails.
Where the RERA Act applies to a project, we will not accept more than ten per cent of the cost of a unit as a booking amount before the Agreement is executed and registered, as Section 13 of that Act requires.
4. Cancellation by you
To cancel a booking, send a written cancellation request signed by every applicant, with the booking reference, our receipt, and details of a bank account in the name of the applicant who paid. Deliver it to our registered office in Mohali or through the Grievance Officer contact published on our Contact page. The cancellation takes effect on the date we receive the complete request.
- Before the Agreement is executed: we refund the booking amount in full, less only any deduction stated in booking terms you accepted in writing and the statutory items in section 6.
- After the Agreement is executed: the cancellation, forfeiture and refund terms of the Agreement apply. Any amount we retain will not exceed what the Agreement and applicable law permit.
5. Cancellation or failure on our part
If we cannot allot the unit you booked, cancel your booking for a reason not attributable to you, or accept a payment in error, we refund the full amount received without deduction. Where the RERA Act entitles you to a refund with interest and compensation, for example under Section 18 or 19, that right applies in full.
6. Statutory items
The following are handled as the law requires and are not our charges:
- GST collected on a booking amount is refunded or adjusted to the extent GST law lets us reverse or recover it;
- tax deducted at source under the Income-tax Act is dealt with as that Act and the Agreement provide;
- stamp duty and registration fees paid to the State Government are not refundable by us; any refund must be claimed from the stamp authority under the applicable stamp law.
We deduct no payment gateway or bank charges unless you agreed to them in writing before paying.
7. Processing timelines
We will initiate a refund within 30 days of receiving a complete cancellation request under section 4, or within any shorter period the Agreement or the law requires. Your bank or payment provider usually credits it within 5 to 10 working days of initiation. We will share the transaction reference.
Incomplete documents, mismatched bank details or disputes between joint applicants extend these timelines.
8. Mode of refund
- Refunds go to the original payment method.
- If that is not possible (for example, a closed card or account), we refund by bank transfer to a verified account in the name of the applicant who paid.
- For joint applicants, we refund as all of them instruct in writing, to an account held by one or more of them.
- We do not make cash refunds, or refund anyone other than the applicant or applicants.
9. Failed, duplicate and excess payments
A failed payment debited from your account is reversed by your bank or payment provider within the Reserve Bank of India's turnaround times for failed transactions. We refund any duplicate or excess payment in full, without deduction, to the original payment method within 7 working days of confirming it.
10. Questions and grievances
Raise any question or complaint about a payment or refund through the Grievance Officer contact published on our Contact page, or call +91 98727 39696 or +91 98726 39696. Where the Consumer Protection (E-Commerce) Rules, 2020 apply to a website payment, we will acknowledge your complaint within 48 hours and resolve it within one month.
Raise any payment problem with us before seeking a chargeback from your bank. A chargeback does not by itself cancel a booking; cancellation follows section 4. This policy does not limit your right to approach the Real Estate Regulatory Authority, Punjab, a consumer commission or a court.
